The following terms and conditions govern all use of the Network 125 websites and all content, services and products available at or through the websites and channels, including, but not limited to, Network125.com, TVandVideoGuide.com, Channel125.com, ChannelLiveTV.com, Sports125.com, FitandSexyTV, CombatTV, HotRadio125.com, KocoNutz, and Backyard Wrestling. The Websites and channels are owned and operated by Network 125. The Websites and channels are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Network 125's Privacy Policy) and procedures that may be published from time to time on these Sites by Network 125 (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Websites or Channels. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Network 125, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

TVandVideoGuide.com The Network 125 Internet TV and Video Guide is a paid service that is meant only to guide or direct members to third party directories, channels, and online videos. Network 125 is not responsible for the usability of any third party site.

If you choose a Subscription Service (including any pre-paid subscription option which reverts to a monthly payment plan at the expiration of the pre-paid period), you agree that Network 125 may automatically charge the subscription fee to your chosen payment method at the beginning of each period. Your access to The Network 125 Internet TV and Video Guide Subscription Service will not be established until Network 125 has verified that the credit card or other payment information you provide Network 125 for payment is accurate and that your credit card account or other payment method account is in good standing. You further agree that Network 125 may charge any other applicable fees for The Network 125 Internet TV and Video Guide Service, including any early termination fee, to your credit card. Network 125 reserves the right to suspend or terminate your access to The Network 125 Internet TV and Video Guide Service without notice upon rejection of any credit card charges or if your card issuer (or its agent or affiliate) seeks return of payments previously made to Network125 when Network 125 believes you are liable for the charges. You are required to keep your billing information current, complete and accurate (such as a change in billing address, credit/debit card number or expiration date) and notify Network 125 if your selected payment method is canceled (e.g., for loss or theft). You are responsible for all charges incurred under your account made by you or anyone who uses your account. You agree to pay any outstanding balance in full within thirty (30) days of purchase of a particular product or service on the Network 125. Additionally, Network 125 reserves the right to deactivate Subscription Services to your account if payment is past due, regardless of the dollar amount.

Other Terms:

Responsibility of Website Visitors. Network 125 has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Network 125 does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Network 125 disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which Network 125 links, and that link to Network 125. Network 125 does not have any control over those non-Network 125 websites and webpages, and is not responsible for their contents or their use. By linking to a non-Network 125 website or webpage, Network 125 does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Network 125 disclaims any responsibility for any harm resulting from your use of non-Network 125 websites and webpages.

Copyright Infringement and DMCA Policy. As Network 125 asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Network 125 violates your copyright, you are encouraged to notify Network 125 (dick@channel125.com). Network 125 will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of Network 125 or others, Network 125 may, in its discretion, terminate or deny access to and use of the Websites. In the case of such termination, Network 125 will have no obligation to provide a refund of any amounts previously paid to Network 125.

Termination. Network 125 may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Network 125 account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have an other service account, such account can only be terminated by Network 125 if you materially breach this Agreement and fail to cure such breach within thirty (30) days from Network 125 notice to you thereof; provided that, Network 125 can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

These Terms of Sale, including the Terms of Service, constitute the entire agreement between you and Company regarding purchases you make on Network 125, superseding any prior agreements between you and Network 125 relating to such purchases. The failure of Company to exercise or enforce any right or provision of these Terms of Sale shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of these Terms of Sale shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions. In the event of a conflict between these Terms of Sale and the Terms of Service, these Terms of Sale shall be controlling.
